Your continued use of Shvoong Homework shall be deemed to attest to your agreement to any modifications of these Terms of Use.

2. Description of Shvoong Homework

Shvoong Homework has been designed to provide you with a user-friendly tool to assist you and your education. Shvoong Homework allows you to coordinate your school/high-school/college work and share your work with a group of people which you will choose. Shvoong Homework can also be used as a storage area which will provide you with easy access to your previous work assignments.

Your use of Shvoong Homework and the contents found therein should not be used as a substitute for your own hard work and effort in learning.

The pages of Shvoong Homework may include advertising and such advertising is required in order for the continued functioning of Shvoong Homework.

3. Registration
|
In order to view certain pages on Shvoong Homework you do not have to register with the Shvoong Homework but you will still be bound by these Terms of Use. In order to create pages and use the full range of services on Shvoong Homework you will be required to complete the simple registration process which will require you to submit a valid email address. We ask you to ensure that you provide us with a correct and functional email address as part of your registration with Shvoong Homework. It will be your responsibility to ensure that the email address provided by you is updated as and when required.

4. Providing Work

You shall retain ownership of any rights that you have in the Work, but by providing Work to Shvoong Homework you are granting us a license to post the Work in whole or in part on Shvoong Homework and to allow other selected users to view and use the Work.

5. Work Guidelines

You agree not to use Shvoong Homework to:

(i) provide Work that is unlawful, harmful, threatening, abusive, harassing, vulgar, obscene, libelous, hateful, or otherwise objectionable;

(ii) deliberately harm or distress any others users of Shvoong Homework in any way;

(iii) provide Work that you do not have a right to make available under any law including laws relating to intellectual property rights; or

(iv) upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware.

You acknowledge that Shvoong may or may not pre-screen your Work prior to your uploading it to Shvoong Homework, but we shall have the right in our sole discretion to refuse, edit or remove Work or any part thereof.

6. Shvoong Homework Misuse

Shvoong Homework is offered to you for your benefit and for the benefit of those people you are willing to share your Work with. Please do not misuse Shvoong Homework in any way. Shvoong retains the right to review all actions taken by you on Shvoong Homework and in the event that Shvoong reasonably believes that you have breached these Terms of Use Shvoong shall be entitled to terminate your registration with Shvoong Homework, remove and delete your Work and take action to block your future use of Shvoong Homework.

7. Privacy Policy

You hereby acknowledge that in registering for and using Shvoong Homework you may be required to provide us with certain personal details about yourself. While we will keep this information confidential you agree that it may be necessary, from time to time, for us to disclose certain of these details to third parties and you consent to such disclosures.

8. Personal Use

Shvoong Homework is offered to you for your personal use and neither Shvoong Homework nor any Work may be used by you for any commercial purpose whatsoever nor shall you facilitate a commercial use by any third party.

Shvoong Homework shall contain links to other Internet sites ( “Other Sites” ). You recognise that Shvoong has no control over the Other Sites and the services, products or goods offered therein and you hereby agree that Shvoong is not responsible for the availability and functionality of the Other Sites; nor does Shvoong make any representations or endorsements whatsoever regarding the services, products or goods offered on the Other Sites. You further acknowledge and agree that Shvoong shall not be responsible or liable for any damage or loss suffered by you in connection with the Other Sites.

10. The Continuance of Shvoong Homework

Shvoong reserves the right to suspend, modify and terminate Shvoong Homework and the services at any time and at its sole discretion and without prior notice to you and you shall have no claims whatsoever against Shvoong in relation to such action, if taken. Therefore, we encourage you to make and keep backup copies of all Work which you provide to Shvoong Homework.

11. No Warranty
|
You agree that your use of Shvoong Homework and your use of any contents found on Shvoong Homework is at your own risk. Shvoong Homework and all the Work are provided to you “AS IS”. Neither Shvoong nor any of its shareholders, directors, officers or employees make any warranty or representation, whether express or implied, that Shvoong Homework or the Work is fit for any purpose or is complete or accurate in any way.

12. Limitation of Liability

To the fullest extent permitted by applicable law, neither Shvoong nor any of its shareholders, directors, officers or employees shall be liable to you for any loss or damage suffered by you as a consequence of your use of Shvoong Homework or the Work, whether direct or indirect, even where we have been notified of the possibility of such loss or damage.

13. Governing Law

These Terms of Use and any matters relating hereto shall be governed by, and construed in accordance with the laws of the State of Israel. You hereby irrevocably agree that the relevant courts of Tel-Aviv-Jaffa shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning these Terms of Use and any matter arising from there and no other courts shall have any jurisdiction whatsoever in respect of such disputes and you irrevocably waive any right that you may have to object to an action being brought in those courts, or to claim that the action has been brought in an inconvenient forum, or that those courts do not have jurisdiction.

14. General

(i) If any provision of these Terms of Use is held by a court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms of Use and the remainder of the provision in question shall not be affected.

(ii) No waiver by us of any provision of these Terms of Use shall be construed as a waiver of any preceding or succeeding breach of any terms of these Terms of Use.

(iii) Unless otherwise expressly stated, nothing in these Terms of Use shall create or confer any rights or any other benefits to third parties.

(iv) These Terms of Use have been translated to various languages. In the event of a discrepancy between the translated versions of these Terms of Use, the English language version shall prevail.
